Service
We do everything we can to deliver quality products to our customers. Our priority is customer satisfaction and our goal is to provide excellent service.
Hidden defects must be reported immediately after discovery by email shop@vape.ch and corresponding images. Of course, the problem can also be reported to the store in person during normal opening hours.
Products
We are always careful to provide correct product information (e.g. performance, size, weight, etc.). Manual entry can always lead to errors.
Privacy
We only pass on those personal customer data to third parties that are necessary for the execution or payment of the order (e.g. to the post office for delivery, to a collection agency in the event of non-payment, etc.), for customer information or for conducting surveys. Our partners delete the customers' personal data as soon as they are no longer required and in any case after the legally prescribed maximum retention period has expired. All personal data will be treated strictly confidential.

minimum purchase value
There is no minimum purchase value in our online shop or in the branches.
Value-added tax
VAT is included in all retail prices.
Prices
The product prices listed before submitting the online order (in the "Overview" ordering step) are binding and we will cover the packaging costs.
Shipping Rate
The delivery costs vary depending on the purchase value and weight (value of goods without delivery costs and credit notes) and are displayed accordingly at checkout.
Products
Vape.ch reserves the right to limit the delivery quantities for certain products and not to carry out the delivery.
If an ordered product is not available at the time of delivery, it will neither be invoiced nor forwarded later.
duty age
The purchase of tobacco products will be prohibited by law in Switzerland for people under the age of 18 from around mid-2024. Vape.ch has voluntarily adopted the legal smoking age of 18+ since 2017, without any precedent as to whether vaping is part of the tobacco products category. By purchasing products, the customer confirms that they are 18 years or older.
order confirmation
All orders are confirmed by us. We send the customer an order confirmation to the specified email address. If the e-mail address was entered incorrectly by the customer, the confirmation is still valid.
Payment via one of the payment options offered is considered confirmation of the order by the customer.
The contractual relationship comes about through the customer's order and our electronic acceptance of this order. The customer can no longer cancel the order after we have confirmed it.

Payment Methods
In our branches you can pay with all common cards such as American Express, Mastercard, VISA, TWINT, Postcard and cash.
Current electronic payment methods can also be used online and ordered on account.
Purchase on account with partial payment option (POWERPAY)
As an external payment service provider, MF Group / POWERPAY offers the payment method “purchase on account”. With the individual invoice, you can easily pay for your online purchase by invoice. If you choose not to make a payment within the specified time frame, you will receive a monthly invoice with an overview of the order in the following month.
When concluding the purchase contract, POWERPAY takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, in addition to our terms and conditions, you accept the terms and conditions of POWERPAY. (powerpay.ch/de/agb). All transfers must be paid in accordance with the information (invoices) provided by POWERPAY and not transferred to VENDEX AG.
credit-worthiness
We reserve the right to make the delivery of orders dependent on a credit check. By placing an order, customers consent to obtaining a credit report.
We reserve the right to make the delivery of orders dependent on advance payment or the provision of security.
We may cancel or suspend an order if the customer does not have creditworthiness, has one or more outstanding invoices with us, or if there is reasonable suspicion of fraudulent intent.
refunds, credits, Vouchers
If the customer is entitled to refunds or other credits, these will be credited to the customer account and can be used for purchases from us within the statutory periods. After this period, the credit expires.
The purchase of vouchers is only possible without a regular customer discount.
Our vouchers cannot be sold or auctioned under any circumstances. Only one voucher can be used per order.
Refusal to Accept Orders
If you refuse to accept the order, the delivery will be sent back to us at our expense. The resulting costs will be deducted in full from the customer's credit. Shipping, any bank fees for return transfers and an expense allowance of 10%, up to a maximum of CHF 30, are owed to VENDEX AG and will be retained directly.

Delivery Area
Deliveries are limited to the territory of Switzerland and Liechtenstein as well as the EU countries.
After we have confirmed the order, the products will be delivered to the address specified by the customer when placing the order.
Customs / VAT / Tracking
Every customer is responsible for finding out about the current laws in their country before placing an order. VENDEX AG cannot carry out a check of the current legal situation per order and delivery country and is not responsible if the relevant customs object to / withholds / destroys the delivery. Our products are all 100% available for sale in Switzerland without any restrictions. Shipping declarations are always filled out correctly and no customer requests can be accepted.
For orders outside Switzerland, customers are responsible for VAT themselves. Customs usually invoices customers for this. VENDEX AG cannot provide any information about the duration of processing by customs or the costs billed. The tracking number you receive can be used for this purpose. If no delivery has arrived after more than 4 weeks, we can initiate an investigation by the post office on behalf of the customer upon request. This is only possible if the order was ordered with a tracking number. Unfortunately, it is not possible to investigate shipping services without a tracking number.
Delivery times
Orders are processed on working days and handed over to Swiss Post for delivery. The delivery time corresponds to the selected shipping method (Economy / Priority / Saturday delivery).
Deviations in time are possible, especially on peak days with an exceptionally high order volume, whereby any claims for damages by the customer are excluded.
The customer assumes responsibility for the delivered products, even if they were left at the door of his home or company or with a neighbor in his absence. We are not responsible for missing packages. If you believe the delivery is incomplete, the customer must contact VENDEX AG within 24 hours of receiving the goods. There is only a time window of 7 days from delivery possible for making a complaint to the transport company.
Pick up the order
Pickup location
Orders can be picked up from our branches during the published opening hours I nachdem the customer has received notification that the order is ready for collection.
Order confirmation
After the order has been sent, the customer will automatically receive an order confirmation by e-mail. This serves as a collection ticket and must either be printed out or shown on the customer's mobile phone. The order cannot be handed over to the customer without this pick-up slip. The customer will be asked to confirm his/her pick-up with his/her signature. Any liability for damage incurred by the customer as a result of the loss or theft of the collection ticket is expressly excluded.
Returns / Right of Withdrawal
For hygienic reasons, the following products are subject to return and the right of withdrawal locked out:

For a withdrawal or use of the right of withdrawal is mandatory via https://vape.ch to make a return request via the customer area. Please do not send us any goods without first contacting us.
Return shipping is the responsibility of the customer and will not be refunded. The products must be in their original packaging and completely unopened. Otherwise a return is excluded. A return is only possible during 10 working days after purchase.
In the case of returns, the credit can be reduced by up to 25% of the sales value for administrative work. The credit will be returned through the same channel as the money was received. If you choose to pay by bank transfer, you must provide us with the appropriate bank details.
In-store returns must be initiated using a fully completed form.
Warranty
We grant a guarantee period of 3 months and 24 months manufacturer guarantee on all products.
Exceptions to this are:
- Batteries and batteries after successful commissioning
- Devices that have been manipulated, such as firmware updates.
- Devices damaged by liquids
- Evaporator*

- Products without receipt/proof of purchase
- Products without outer packaging with the serial number -> Especially with hardware, the packaging must be kept for warranty claims
If there is no warranty claim, the buyer assumes the costs for any error analysis.
There is no entitlement to a replacement device during the repair / Spare Parts etc.
Further warranty claims such as rescission (cancellation of the purchase contract due to defects in the purchased item) and reduction are excluded.
* When a vaporizer bubbles (feeling/sound when pulling)
or siffs (leaks or drips), we can certainly help with a tip from the community, but this is not a guaranteed case.
Regular customers / loyalty program -> does not apply to B2B
Regular customers* can benefit from voluntary discount levels that can be changed at any time, depending on their sales. By creating a customer account, purchases made online will be credited accordingly. In order to be credited in the store, the name of the customer account must be provided before payment. After payment, subsequent crediting is unfortunately not possible for technical reasons. The account is personal and may not be shared with other customers. If there is suspicion of misuse, VENDEX AG can delete the discount at any time.
Vouchers can only be purchased without a regular customer discount, and high-end products in the upper price segment are also excluded from the regular customer discount.
Current discount levels can be requested in store or by telephone. The current status is shown on the invoice for each order.
* Regular customers are customers who have created a personal user account.
Transferability of customer account
The customer account at https://Vape.ch can only be used by its owner. If it is suspected that several people are using it, we can delete the discount level from the corresponding customer account at any time and without prior notice. There is no entitlement to a discount level.
Affiliate
VENDEX AG offers regular customers a partner program. Every customer with at least one valid order can participate in the program free of charge. The current conditions can be seen in the personal customer area (visible online after login). Through the partner program, every customer can receive credits on their account and use them for purchases at VENDEX AG in stores or online.
The partner program is a voluntary service by VENDEX AG and can be discontinued at any time. In the event of misuse or suspicion of misuse, the personal account in the partner program can be blocked without notice and any credit will expire without any right to payment/credit. If misuse is suspected, the partner program in the personal account can also be temporarily paused until VENDEX AG has been able to carry out the clarifications that are currently necessary. The deciding factor always lies with VENDEX AG.
In the partner program, the current legal situation regarding the protection of minors must be observed. Under no circumstances should minors come into contact with it. We hereby disclaim any liability. This is the responsibility of each customer who wishes to participate in the affiliate program and wants to add a new customer to the affiliate program. The customer must ensure that the new partner is of legal age.
New partners must always provide 1. a full address / 2. telephone number and 3. the date of birth. Credits will not be granted without Full Address / Telephone Number / Date of Birth.
VENDEX AG reserves the right to carry out spot checks at any time (e.g. request photo ID with live video chat, etc.).
Outstanding payments
If the customer does not pay the invoice for an order on time, we reserve the right to block all further orders until the outstanding amount is settled. Of course, we will collect every open claim with all legal measures, regardless of the amount.
Liability
VENDEX AG is only liable for direct damage caused intentionally or through gross negligence. Liability for indirect damage and damage caused by negligence is excluded. In particular, VENDEX AG is not liable for the costs of consequential damage of any kind resulting from the use of defective parts. Liability for damage resulting from violation of product safety regulations is excluded to the extent permitted by law.
Severability
The invalidity or unenforceability of individual provisions of these general terms and conditions does not affect the legal validity of these as a whole. The ineffective provision shall be replaced by one that comes as close as possible to the original, unenforceable provision in legal and economic terms. The same applies in the event that there are any loopholes in this agreement.
Applicable Law and Jurisdiction
Swiss law is exclusively applicable, excluding the UN Sales Convention (CISG).
Place of jurisdiction is 8610 Uster in Switzerland
Changes / Additions
VENDEX AG expressly reserves the right to adapt or change these General Terms and Conditions (GTC) to the circumstances at any time and to apply them immediately.
